Privacy Policy

This Privacy Policy explains how Vivana Properties, Inc. collects, uses, and protects information when you visit vivanaproperties.com or communicate with us.

Last updated: August 2026

01Who we are

Vivana Properties, Inc. (a Delaware corporation, together with its affiliated operating companies, “Vivana,” “we,” “us,” or “our”) operates the website at vivanaproperties.com (the “Site”). We are a family of multifamily operating companies. This Site is an informational and relationship-building property; it is not a resident portal, tenant application, or transactional platform.

02Information we collect

We collect a limited amount of information, and only in the ways described below.

Information you give us directly

The Site’s primary call to action is to “Start a Conversation,” which opens an email to our partnerships team. When you email us — or, where offered, submit a contact or newsletter sign-up form — we receive the information you choose to provide, such as your name, email address, company, and the contents of your message.

Marketing and newsletter communications

If you sign up to receive updates from us, we collect your email address (and any other details you provide) in order to send those communications. You can unsubscribe at any time using the link in any message or by contacting us.

Information collected automatically

When you visit the Site, we and our analytics providers may automatically collect standard technical information, including your IP address, browser type, device information, pages viewed, referring URLs, and the dates and times of your visits. This is used to understand how the Site is used and to improve it.

We do not knowingly collect sensitive personal information (such as government IDs, financial account numbers, or health data) through this Site, and we ask that you not send it to us.

03How we use information

We use the information we collect to:

  • Respond to your inquiries and communicate with you about a potential partnership;
  • Send newsletters, updates, or marketing communications you have requested;
  • Operate, maintain, secure, and improve the Site;
  • Understand aggregate usage trends through analytics; and
  • Comply with our legal obligations and enforce our Terms & Conditions.

We do not sell your personal information, and we do not share it for cross-context behavioral advertising.

04Cookies & analytics

The Site uses cookies and similar technologies. Cookies are small text files stored on your device that help the Site function and let us measure usage.

  • Essential cookies are necessary for the Site to work properly.
  • Analytics cookies (for example, from a provider such as Google Analytics) help us understand how visitors interact with the Site so we can improve it.

You can control or disable cookies through your browser settings. Disabling some cookies may affect how the Site functions. Where required by law, we will request your consent before setting non-essential cookies.

05How we share information

We share personal information only in these limited circumstances:

  • Service providers. With vendors who perform services for us — such as email, hosting, and analytics providers — under agreements that require them to protect the information.
  • Within our ecosystem. With Vivana affiliates and operating companies where relevant to responding to your inquiry about a partnership.
  • Legal and safety. When required by law, subpoena, or legal process, or to protect the rights, safety, or property of Vivana or others.
  • Business transactions. In connection with a merger, acquisition, financing, or sale of assets, consistent with this Policy.

06Data retention

We retain personal information for as long as needed to fulfill the purposes described in this Policy — for example, to maintain our correspondence with you and our business relationship — and thereafter as required to comply with our legal obligations, resolve disputes, and enforce our agreements.

07Security

We use reasonable administrative, technical, and physical safeguards designed to protect the information we collect. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

08Your privacy rights

Depending on where you live, you may have rights to access, correct, delete, or obtain a copy of the personal information we hold about you, and to opt out of marketing communications. To exercise any of these rights, contact us using the details below. We will respond as required by applicable law, and we will not discriminate against you for exercising your rights.

09California residents (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act, provides you with specific rights regarding your personal information:

  • Right to know the categories and specific pieces of personal information we have collected, the sources, the purposes for collecting it, and the categories of third parties with whom we share it.
  • Right to delete personal information we have collected from you, subject to certain exceptions.
  • Right to correct inaccurate personal information.
  • Right to opt out of the sale or sharing of personal information. We do not sell or share personal information as those terms are defined under the CCPA/CPRA.
  • Right to non-discrimination for exercising your privacy rights.

In the preceding 12 months, we may have collected the following categories of personal information: identifiers (such as name and email address), internet or network activity (such as browsing data on the Site), and any information you voluntarily include in your communications. To submit a request, or to appoint an authorized agent to do so, contact us at partnerships@vivanaproperties.com. We will verify your request using the information associated with your communications with us.

10Children’s privacy

The Site is intended for a business audience and is not directed to children under 16. We do not knowingly collect personal information from children. If you believe a child has provided us information, please contact us and we will delete it.

11Third-party links

The Site may link to third-party websites, including those of our operating companies and partners. We are not responsible for the privacy practices of those sites, and we encourage you to review their privacy policies.

12Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date above. Material changes will be indicated on this page. Your continued use of the Site after changes take effect constitutes acceptance of the revised Policy.
